The court of Appeal sitting in Abuja over the Imo North Senatorial election matter had validated the judgement of Justice M. Kwajafa led National Election Petition Tribunal in favour of Senator Benjamin Uwajumogu, of the All Progressives Congress (APC), in the July 22 and 28, 2016, Okigwe Senate rerun elections to the utmost disappointment of the Peoples Democratic Party counterpart, Chief Athan Nneji Acholonu.

In the court presided by Hon. Justice  J. C. A Aboki led five man panel in their unanimous summary judgment delivered on Thursday, April 6,2017, stated that the appellant, Achonu could not prove his case that 23rd July 2016 supplementary elections were not inconclusive and that the Independent National Electoral Commission, INEC, has no right to refix another supplementary to conclude the July 23rd election.

The court also averred that the PDP candidate could not prove that he won the said July 23rd election or that the 2nd Respondent, Senator Benjamin Uwajumogu was not duly elected and declared winner of the said Imo North election.
